1. TO ENTER: You will automatically earn one entry for each eligible transaction made using your Chicago Cubs Extra Bases™ MasterCard credit card, beginning June 1, 2009 through July 31, 2009 ("Entry Period"). Eligible transactions include only credit card purchases. Entries resulting from transactions made with lost, stolen or fraudulent credit cards are automatically void. Declined or incomplete transactions will not qualify. If you do not wish to use your Chicago Cubs Extra Bases™ MasterCard credit card or do not have a Chicago Cubs Extra Bases™ MasterCard credit card, but wish to enter the sweepstakes, you may enter by hand printing your name, complete address, zip code, daytime phone number and date of birth on a plain 3"X 5" piece of paper. Mail your entry in a hand addressed stamped envelope to: Chicago Cubs MasterCard Sweepstakes, P.O. Box 7912 (Dept. C), Melville, NY 11775-7912. Each entry must be mailed separately, be postmarked by July 31, 2009 and received by August 7, 2009. Mechanically reproduced entries are automatically void. Usage of Chicago Cubs Credit Cards issued by HSBC Bank Nevada N.A. is not eligible for automatic entry in Chicago Cubs MasterCard VIP Experience Sweepstakes.
2. PRIZE: Grand Prize (1): An MLB Club VIP Experience for winner and three (3) guests. Prize includes four (4) tickets to a Sponsor-selected 2009 MLB Chicago Cubs regular season game (the "Game"), Sponsor-selected VIP Experience for four (4) at the Game, four (4) autographed baseballs (sponsor-selected player) and $500 in MasterCard Gift Cards. (Approximate Retail Value: $4,000 each). Transportation and hotel accommodations are not included. Prize must be used on date determined by Sponsor or prize will be forfeited. Terms, conditions & restrictions on gift card may apply, as specified by MasterCard®. Major League Baseball Game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. Winner and his/her guests agree to comply with all applicable ballpark regulations in connection with the prize. Sponsor and the applicable MLB Entities (as defined below) reserve the right to remove or to deny entry to winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the Game, event or exhibition. The MLB Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.
3. RANDOM DRAWING: Winner will be selected in a random drawing from among all eligible entries received during the Entry Period. Drawing will be conducted on or about August 10, 2009, by Don Jagoda Associates, Inc., an independent judging organization (the "Judges") whose decisions are final on all matters relating to this sweepstakes. Approximate odds of winning are dependent upon the number of eligible entries received during the Entry Period. The prize will be awarded and winner will be notified by phone and/or overnight mail.
4. GENERAL RULES: Sponsor/Judges will make 3 attempts to contact potential Grand Prize winner via phone within 48 hours from time of random drawing. If Sponsor is unable to reach the potential winner within this time frame or if potential winner is deemed ineligible, he/she will be disqualified, prize will be forfeited and at Sponsor's sole discretion, time permitting, an alternate potential winner may be chosen from among all remaining eligible entries. Potential Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Release of Liability and, where legal Publicity Release within three (3) days of date of issuance, which will be sent via overnight mail with a pre-paid overnight return envelope enclosed. In the event of non-compliance, or if prize notification letter is returned as undeliverable, prize will be forfeited and an alternate will be selected, time permitting. Grand Prize winner's guests (or parent/legal guardian if a guest is a minor) must execute a Release of Liability prior to attending the Game. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, accommodations and transportation are the responsibility of the winner. All taxes related to the prize are the sole responsibility of the winner. Winner, if a cardholder, must have an account in good standing in accordance with the terms described in the Credit Card agreement in order to receive the prize. In the instance of co-applicant cardholders, the winner is the primary cardholder. Prize is non-transferable and no substitution is allowed, except by the Sponsor who reserves the right to substitute a prize of equal or greater value if advertised prize (or portion of prize) is unavailable. Sponsor, MasterCard International Incorporated (hereinafter "MasterCard"), and Major League Baseball Properties, Inc., Major League Baseball Enterprises, Inc., MLB Advanced Media, L.P., MLB Media Holdings, Inc., MLB Media Holdings, L.P., MLB Online Services, Inc., the Office of the Commissioner of Baseball, Major League Baseball Clubs (hereinafter, "MLB Entities"), and each of their respective shareholders, general and limited partners, employees, parents, subsidiaries, directors, officers, affiliated entities, representatives, agents, successors, and assigns and their agencies assume no responsibility or liability for damages, losses or injury resulting from acceptance or use of the prize. No responsibility is assumed by Sponsor for lost, misdirected, illegible, postage due or late entries or mail, delays in processing credit card transactions, or inaccuracies in processing credit card transactions because of computer error or malfunction. Each promotion entrant acknowledges and agrees that the Sponsor, MasterCard, and the MLB Entities shall have the right (subject to applicable law) to (i) analyze and use his/her name, address, and biographical information (the "information") for any and all purposes, including, without limitation, sending advertising and promotional materials to each entrant and for any other advertising, marketing and promotional purposes; and (ii) to share the information with third parties for their advertising, marketing and promotional purposes or for any other purposes. Each entrant also acknowledges that he/she shall have no right of approval of any use of the information as permitted hereunder; and agrees to release in perpetuity the Sponsor, MasterCard, and the MLB Entities from any claims, demands, losses and liabilities of any nature arising out of or in any way connected, directly or indirectly, in whole or in part, (a) with the information and the use thereof as permitted hereunder, including, but not limited to, claims of false endorsement or infringement of rights of publicity or privacy; and/or (b) from the participation in the sweepstakes or from the receipt or use of prize or any travel or activity related to the receipt or use of prize. Acceptance of prize constitutes permission to use winner's name, photograph and likeness for publicity purposes without further compensation except where prohibited by law. Entrants agree to be bound by these Official Rules and the decisions of the Judges.
5. ELIGIBILITY: Sweepstakes open to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older as of date of entry, except employees, officers and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of FIA Card Services, N.A., Five Star Sports, Bank of America Corporation, MasterCard International Incorporated, the MLB Entities and each of their respective their affiliates, subsidiaries, advertising and promotion agencies, the MLB Entities and Don Jagoda Associates, Inc. This offer is void wherever prohibited, and subject to all federal, state and local laws, rules and regulations.
